The modernization of the Indian Armed Forces, the world’s third largest, is a key priority for the Indian government amidst an increasingly complicated geo-political neighbourhood and growing global instability which has resulted in India being the world’s fourth largest spender on defence with a defence budget of USD 34.53 Billion, of which, 31.1% is assigned to capital acquisitions.

The introduction of the Defence Procurement Procedure-2016, the “Make in India” initiative along with liberalization in Foreign Direct Investment norms and the emphasis on increased domestic private sector participation has provided a singular opportunity to international and national defence and aerospace conglomerates to do business in India.

Our team is uniquely placed to service international and national players in the Defence & Aerospace industry, as we are one of the very few Indian law firms that have a dedicated team of counsels – the Defence Practice Group – with specialization in this sector. We provide comprehensive and commercially pertinent advice on the entire spectrum of issues related to defence procurement in India, with clients ranging from international Original Equipment Manufacturers (OEMs) to Indian Offset Partners.

The Defence Practice group at the Firm works with other practice groups which complement this practice – such as M&A, Civil, Aviation, Tax, Corporate Structuring, Intellectual Property Rights, Competition Law & Anti-Trust and Anti-Corruption & Compliance practice groups. Each of these practice groups are market leaders in their own right, thus enabling our clients in this sector to obtain the most commercially relevant and holistic advice available in the Indian legal market. We are one of the few select law firms in India to have advised extensively on the offset policy as well as reviewed and commented on offset agreements and assisted clients in structuring their offset arrangements with the Indian Offset Partners.

The Firm is empanelled with the Department of Defence Production, Ministry of Defence, Government of India (DDP) as a legal consultant. As part of the empanelment, the Firm is expected to assist the DDP in developing a suitable legal framework for robust and secure private sector engagement in the defence sector, in undertaking a comparative analysis of defence and security laws of different jurisdictions contracting with India and in legal vetting of industrial security arrangements with the United States of America and other countries.

The prevailing Defence Procurement Policy recognizes that there may be occasions when procurement may have to be done from friendly foreign countries which may be necessitated due to geo strategic advantages that are likely to accrue to India. These cases need not classically follow the standard procurement procedure and the contract document would be based on mutually agreed provision by the governments of both countries. We may well be one of India’s few firms to have advised on defence procurement pursuant to an inter-governmental agreement.
